Biden Gun Plan Could Bankrupt the Firearms Industry

Biden’s “Plan To End Our Gun Violence Epidemic” seeks to repeal the Protection of Lawful Commerce In Arms Act. The Act affords firearms dealers and manufacturers legal protection against lawsuits that may result from the misuse of weapons or ammunition sold to the public.

This would effectively leave dealers and sellers vulnerable to wrongful death and injury lawsuits that target the weapon, rather than the perpetrator.

Gun manufacturers could ultimately be put out of business through frivolous lawsuits

Erich Pratt of GOA (Gunowners Of America) said,

“[Biden’s plan] means that gun manufacturers could ultimately be put out of business through frivolous lawsuits,” “It’s totally irresponsible, imagine holding Ford or GM responsible for the damage caused by hit-and-run drivers. We wouldn’t tolerate that and yet that’s exactly the type of legal theory they’re trying to put on gun manufacturers.”

“The guys pushing these lawsuits, they don’t care if they win. They care if they can force these companies to hemorrhage money. They are in the business of putting gun companies out of business.” said Kevin Jamison, a Missouri self-defense lawyer and firearms trainer.

Remington Arms Company, which has been producing firearms since 1816, went bankrupt in late September 2020 after the corporation was sued by the families of the victims involved in the deadly 2012 Sandy Hook school shooting.

Bankruptcy is the desired intent

The country will be seeing “more” of these lawsuits. Remington’s bankruptcy “was the desired intent” of the legal procedure.

Jamison called the theories behind the gun litigation “absurd” and said the lawsuits have been allowed to continue even under the Commerce In Arms Act because of misguided courts.

The death of mom and pop gun shops, and others

“They’ve gotten away with it because the courts have indulged these absurd theories of law,” the gun lawyer said. “It’s a disaster. It has been very bad the last few years, yes, but it’s going to be the death of mom and pop and gun shops — individually-owned gun shops — and some of these companies.”

America’s gun industry will crumble under litigation

Pratt sees the potential for America’s gun industry as a whole to crumble under the weight of litigation that could result from Biden’s plan.

“The idea of the left would be ‘oh sure you can have a Second Amendment right, too bad you just can’t find any guns that are being produced and manufactured,’” he said.

For starters, I am a member of and I contribute to GOA – Gun Owners of America. A fearless lobbying group. I also contribute to other conservative groups who lobby on behalf of gun owners and other conservative issues. I purchase only from American firearm and ammo manufacturers.
We do not have gun registration in our state and any bill that comes forward in the state legislature that even remotely suggests such a thing is quickly put down thanks to our Republican “super-majority” voted in by average people like me.
Yes, Joe Dementia is the president but only those who would comply with his laws are the ones asking to be put in chains.

What is difficult about opposing gun control legislation is that nearly every group that seeks your support also seeks your money.

Not finding any guns?

There are a reported 1,073,743 registered firearms in the US. That was before Biden was elected. Funny with that number there are a reported 72 million gun owners, many own more than 1 firearm, so the number of firearms are way off, and there’s more gun owners than is reported.

If somehow manufacturers are driven out of business, like prohibition, there will probably be the underground making them. We love our guns.

What are “registered firearms”? There are upwards of 10 million guns in ownership today, at least.

I would guess it means firearms linked to a verified background check. These would have to be background checks performed AFTER they started tracking gun sales and background checks in a linked federal database.

I believe the conservative estimate is 200+ million guns in circulation. None of mine are registered and/or in anyone’s “database”. I’ve never bought in a “retail” setting. Oh yes, and I lost them all on a fishing trip.

Recently, the NRA filed bankruptcy after being sued successfully in N.Y. as I recall…and announced a decision to reorganize in Texas.

One of the reasons so many entities are flocking to Texas, and a reason that gets little mention, is Texas’ passage of major tort reforms several years back. Severely limiting exemplary or punitive damages in lawsuits. This makes it much harder for corporations or individuals to be targeted for extinction by ideologues.

I’ve always wondered why so many American iconic firearms manufacturers have remained in anti-gun northeastern states, other than them being their historic homes. I suspect that many will head to more gun friendly turf. Would not be surprised if more gun friendly states come together as 2nd amendment sanctuaries to resist the socio-fascist path the democrats have taken.

It seems a lot of the communist strategy has been to make as many ‘indirect’ attacks as possible. Exposing gun manufacturers to lawsuits is one way to reduce access to firearms without banning them. Letting tech companies restrict free speech is an indirect attack by our communist government, too. Those lines in the sand we’ve drawn aren’t very effective if we’re only waiting for a blatant direct attack. They know this.

When the direct attacks come, the general population will have been weakened and acclimated to an environment of more control, less freedom. Like now. Everything has been in little baby steps, chipping away at freedoms, until something like last year could happen without too many resisting.

When will we take action to stop tyranny? Most likely when we have nothing left to lose. People waiting for a leader, which is probably most of us truth be told, don’t want to lose what they have left. Home, family, work, some freedom to associate and speak (depending on where you live). The direct attack, like some of this legislation, I hope will be a wake up call. We’re already in the corral – the chute is next. Post on NC Renegade with similar thoughts.

One parent homes, two parents working, kids indoctrinated on the socialist liberal progressive agenda since their lazy parents put them in daycare. Because parents are too lazy for to commit to raise their children, every generation becomes more and more brainwashed. Too many children born out of wedlock, easy for them to be indoctrinated by the government schools or worse.

Yes, there are exceptions, but overall, until parents commit to raise their children in a 2 parent Mom and Dad home where Dad provides and Mom nurtures, our society is FUBAR.

Or vice versa. I have suggested to both my daughters their husbands should stay home with the kids. Not that they’re effeminate. My daughters are the main breadwinners and have the better chance for advancement. Both husbands are good parents and can cook.

While I do believe most households with only one adult working outside the home would have the wife at home, the point is to have an adult managing the household and really caring for the kids.

I’ve known single parents, mothers mostly, doing their best to do it all – nurture, school, and provide, with or without support from the absent parent. It’s not easy, and the last thing those single parents need is broad brush judgment from those who have not walked in their shoes.

H.R. 8 passed the House today. Universal Background Checks, no private sales allowed unless the buyer goes through NICS process (background check). Now it goes to the Senate. I’m thinking they’re going to pass it. Haven’t read the whole bill yet, busy, so there could be other stuff in there as well.
